Non-Smoking Private Vehicles

Anyone under the age of 18 is not allowed to smoke in a car (or other vehicle). On October 1, 2015, the law was revised to better safeguard children and teenagers from the effects of secondhand smoke.

The smoker and the driver might each receive a £50 fine. Every motorist in England and Wales is subject to the legislation, including those who are 17 years old or hold a temporary license.

The law applies:

  • any private car with a roof that is completely or partially enclosed
  • when drivers open their windows, raise their sunroofs, or turn on the air conditioning
  • when a smoker occupies an open vehicle doorway.

What is exempt from the law”

  • e-cigarettes (vaping)
  • a 17-year-old driver who is traveling alone in a vehicle
  • a convertible vehicle with the top down
